Our present crises are growing more urgent, pervading many domains of public life—economic, political, environmental, and social. This motivates scholars to find more adequate, combinatory perspectives from which to explain them. One such effort, under the broad heading of Law and Political Economy (LPE), challenges an established view of legality that insulates the market and its dominant actors from critique and accountability. The established view is based on two misconceptions. First, it sees the real function of a capitalist legal device, (...) whether in contracts, antitrust, property, or corporate law, in terms of efficient wealth creation; this function is its underlying rationale and normative aim. Second, it tends to remove equality, coercion, and legitimacy—the core problems of power—from the scope of economic appraisal. When laws and policies are fashioned out of these ideas, democratic institutions will be unable to counter the dominance of capital. New analytical approaches are therefore necessary (Purdy et al. 2020). Along with researchers in associated fields, LPE scholars are attempting to better understand the legal constructions in which financial and political power are anchored and to develop new ways of integrating the economy into democratic life. Robé is a leading voice in these debates. His new book, Property, Power, and Politics, encloses in one volume his ideas on the role of incorporated firms—and of markets, property, and finance—in the larger dynamics of global politics. In this symposium, interlocutors with backgrounds in law, political science, and philosophy engage with this rich analysis. This introduction provides an overview of the book’s arguments (sections 2 and 3) and then introduces the contributions (section 4). (shrink)

In General Relativity in Hamiltonian form, change has seemed to be missing, defined only asymptotically, or otherwise obscured at best, because the Hamiltonian is a sum of first-class constraints and a boundary term and thus supposedly generates gauge transformations. Attention to the gauge generator G of Rosenfeld, Anderson, Bergmann, Castellani et al., a specially _tuned sum_ of first-class constraints, facilitates seeing that a solitary first-class constraint in fact generates not a gauge transformation, but a bad physical change in electromagnetism or (...) General Relativity. The change spoils the Lagrangian constraints, Gauss's law or the Gauss-Codazzi relations describing embedding of space into space-time, in terms of the physically relevant velocities rather than auxiliary canonical momenta. But the resemblance between the gauge generator G and the Hamiltonian H leaves still unclear where objective change is in GR. Insistence on Hamiltonian-Lagrangian equivalence, a theme emphasized by Castellani, Sugano, Pons, Salisbury, Shepley and Sundermeyer among others, holds the key. Taking objective change to be ineliminable time dependence, one recalls that there is change in vacuum GR just in case there is no time-like vector field xi^a satisfying Killing's equation L_xi g_mn=0, because then there exists no coordinate system such that everything is independent of time. Throwing away the spatial dependence of GR for convenience, one finds explicitly that the time evolution from Hamilton's equations is real change just when there is no time-like Killing vector. The inclusion of a massive scalar field is simple. No obstruction is expected in including spatial dependence and coupling more general matter fields. Hence change is real and local even in the Hamiltonian formalism. The considerations here resolve the Earman-Maudlin standoff over change in Hamiltonian General Relativity: the Hamiltonian formalism is helpful, and, suitably reformed, it does not have absurd consequences for change and observables. Hence the classical problem of time is resolved. The Lagrangian-equivalent Hamiltonian analysis of change in General Relativity is compared to Belot and Earman's treatment. The more serious quantum problem of time, however, is not automatically resolved due to issues of quantum constraint imposition. (shrink)

We report two experiments in which participants had to judge the time of occurrence of a stimulus relative to a clock. The experiments were based on the control condition used by Libet, Gleason, Wright, and Pearl [Libet, B., Gleason, C. A., Wright, E. W., & Pearl, D. K. . Time of conscious intention to act in relation to onset of cerebral activities : The unconscious initiation of a freely voluntary act. Brain 106, 623–642] to correct for any bias in the (...) estimation of the time at which an endogenous event, the conscious intention to perform a movement, occurred. Participants’ responses were affected systematically by the sensory modality of the stimulus and by the speed of the clock. Such findings demonstrate the variability in judging the time at which an exogenous event occurs and, by extension, suggest that such variability may also apply to the judging the time of occurrence of endogenous events. The reliability of participants’ estimations of when they formed the conscious intention to perform a movement in Libet et al.’s study is therefore questionable. (shrink)

Empirical work on motivated reasoning suggests that our judgments are influenced to a surprising extent by our wants, desires and preferences (Kahan 2016; Lord, Ross, and Lepper 1979; Molden and Higgins 2012; Taber and Lodge 2006). How should we evaluate the epistemic status of beliefs formed through motivated reasoning? For example, are such beliefs epistemically justified? Are they candidates for knowledge? In liberal democracies, these questions are increasingly controversial as well as politically timely (Beebe et al. 2018; Lynch forthcoming, 2018; (...) Slothuus and de Vreese 2010). And yet, the epistemological significance of motivated reasoning has been almost entirely ignored by those working in mainstream epistemology. We aim to rectify this oversight. Using politically motivated reasoning as a case study, we show how motivated reasoning gives rise to three distinct kinds of skeptical challenges. We conclude by showing how the skeptical import of motivated reasoning has some important ramifications for how we should think about the demands of intellectual humility. (shrink)

Contemporary discussion concerning institutions focus on, and mostly accept, the Searlean view that institutional objects, i.e. money, borders and the like, exist in virtue of the fact that we collectively represent them as existing. A dissenting note has been sounded by Smit et al. (Econ Philos 27:1–22, 2011), who proposed the incentivized action view of institutional objects. On the incentivized action view, understanding a specific institution is a matter of understanding the specific actions that are associated with the institution and (...) how we are incentivized to perform these actions. In this paper we develop the incentivized action view by extending it to institutions like property, promises and complex financial organisations like companies. We also highlight exactly how the incentivized action view differs from the Searlean view, discuss the method appropriate to such study and discuss some of the virtues of the incentivized action view. Recent work on the history of General Relativity by Renn, Sauer, Janssen et al. shows that Einstein found his field equations partly by a physical strategy including the Newtonian limit, the electromagnetic analogy, and energy conservation. Such themes are similar to those later used by particle physicists. How do Einstein's physical strategy and the particle physics derivations compare? What energy-momentum complex did he use and why? Did Einstein tie conservation to symmetries, and if so, to which? How did his work (...) relate to emerging knowledge of the canonical energy-momentum tensor and its translation-induced conservation? After initially using energy-momentum tensors hand-crafted from the gravitational field equations, Einstein used an identity from his assumed linear coordinate covariance x'=Mx to relate it to the canonical tensor. Usually he avoided using matter Euler-Lagrange equations and so was not well positioned to use or reinvent the Herglotz-Mie-Born understanding that the canonical tensor was conserved due to translation symmetries, a result with roots in Lagrange, Hamilton and Jacobi. Whereas Mie and Born were concerned about the canonical tensor's asymmetry, Einstein did not need to worry because his Entwurf Lagrangian is modeled not so much on Maxwell's theory as on a scalar theory. Einstein's theory thus has a symmetric canonical energy-momentum tensor. But as a result, it also has 3 negative-energy field degrees of freedom. Thus the Entwurf theory fails a 1920s-30s a priori particle physics stability test with antecedents in Lagrange's and Dirichlet's stability work; one might anticipate possible gravitational instability. This critique of the Entwurf theory can be compared with Einstein's 1915 critique of his Entwurf theory for not admitting rotating coordinates and not getting Mercury's perihelion right. One can live with absolute rotation but cannot live with instability. Particle physics also can be useful in the historiography of gravity and space-time, both in assessing the growth of objective knowledge and in suggesting novel lines of inquiry to see whether and how Einstein faced the substantially mathematical issues later encountered in particle physics. This topic can be a useful case study in the history of science on recently reconsidered questions of presentism, whiggism and the like. Future work will show how the history of General Relativity, especially Noether's work, sheds light on particle physics. (shrink)

The Peter Principle states that employees tend to be promoted until they reach their level of incompetence. In a sophisticated simulation study, Pluchino et al confirmed a version of the principle. However, they also noted that their model has the counterintuitive consequence that “the best ways for improving the efficiency of a given organization are either to promote each time an agent at random or to promote randomly the best and the worst members”. We argue that what promotion rule is (...) used can in general influence employee productivity. Accommodating this psychological aspect of promotion is noted as an open problem by Pluchino et al. Using an amended simulation model we verify that if the incentive induced by promoting the best is strong enough, then that strategy will be optimal. In a final simulation experiment we consider the effect on the efficiency of an organization of using “double standard” promotion strategies, i.e., strategies that depend on the official promotion rule being different from the de facto promotion rule. We show that double standard promotion strategies can be highly efficient, although we also note that in using such strategies the employer may take an unacceptable medium to long term risk. The paper by Mand et al raises important questions about the predictive genetic testing of children. They focus on those claims made by professionals that are open to empirical enquiry and give too little weight to those claims that do not require empirical support. The authors remind us that some commentators oppose empirical enquiry because of the concern that gathering evidence of the consequences of such testing may itself be harmful or unethical. They respond by asserting that the relevant research (...) questions are ‘eminently testable’ but fail to discuss the challenges of such research, including the questions of timescale, consent or the nature of the data whose collection (they assert) would resolve the perceived difficulties with the genetic testing of children. They conclude that empirical research is required without resolving the weighty arguments against predictive testing of young children or explaining how the evidence they wish to collect could overcome the force of the arguments that favour caution. The questions of what represents space-time in GR, the status of gravitational energy, the substantivalist-relationalist issue, and the exceptional status of gravity are interrelated. If space-time has energy-momentum, then space-time is substantival. Two extant ways to avoid the substantivalist conclusion deny that the energy-bearing metric is part of space-time or deny that gravitational energy exists. Feynman linked doubts about gravitational energy to GR-exceptionalism, as do Curiel and Duerr; particle physics egalitarianism encourages realism about gravitational energy. In that spirit, this essay (...) proposes a third possible view about space-time, one involving a particle physics-inspired non-perturbative split that characterizes space-time with a constant background _matrix_, a sort of vacuum value, thus avoiding the inference from gravitational _energy to substantivalism. On this proposal, space-time is, where eta=diag is a spatio-temporally constant numerical signature matrix, a matrix already used in GR with spinors. The gravitational potential, to which any gravitational energy can be ascribed, is g_{\mu\nu}- eta, an _affine_ geometric object with a tensorial Lie derivative and a vanishing covariant derivative. This non-perturbative split permits strong fields, arbitrary coordinates, and arbitrary topology, and hence is pure GR by almost any standard. This razor-thin background, unlike more familiar backgrounds, involves no extra gauge freedom and so lacks their obscurities and carpet lump-moving. After a discussion of Curiel's GR exceptionalist denial of the localizability of gravitational energy and his rejection of energy conservation, the two traditional objections to pseudotensors, coordinate dependence and nonuniqueness, are explored. Both objections are inconclusive and getting weaker. A literal interpretation involving infinitely many energies corresponding by Noether's first theorem to the infinite symmetries of the _action_ largely answers Schroedinger's false-negative coordinate dependence problem. Bauer's false-positive objection has multiple answers. Non-uniqueness might be handled by Nester et al.'s finding physical meaning in multiplicity in relation to boundary conditions, by an optimal candidate, or by Bergmann's identifying the non-uniqueness and coordinate dependence ambiguities as one. I analyze a number of the quantum no-signalling proofs (Ghirardi et al. 1980, Bussey 1982, Jordan 1983, Shimony 1985, Redhead 1987, Eberhard and Ross 1989, Sherer and Busch 1993). These purport to show that the EPR correlations cannot be exploited for transmitting signals, i.e., are not causal. First, I show that these proofs can be mathematically unified; they are disguised versions of a single theorem. Second, I argue that these proofs are circular. The essential theorem relies upon the tensor product (...) representation for combined systems, which has no physical basis in the von Neumann axioms. Historically, the construction of this representation scheme by von Neumann and Weyl built no-signalling assumptions into the quantum theory. Signalling between the wings of the EPR-Bell experiments is unlikely but is not ruled out empirically by the class of proofs considered. (shrink)

Muraskas et al. and Hefferman and Heilig present the painfully elusive ethical questions regarding decisionmaking in the care of the extremely low birth weight infants in the intensive care nursery. At what gestation or size do we resuscitate? Can we stop resuscitation after we have started? How much money is too much to spend? Is the distress of the parents of the ELBW infant, the anguish of their caregivers, and the moral and ethical uncertainty of the approach to these infants (...) too much to pay? Who speaks for the neonate: the parent, nurse, attorney, or physician? Ideally these questions should have been answered 30 years ago when modern neonatology embarked on a journey from where it could not return. A new breed of physician, called “neonatologist,” seduced by the high-tech lure and the promise of saving lives previously unsavable pioneered a lucrative and life-saving technological revolution in the care of premature newborns. This rapid advancement in neonatology occurred a few years after the death of a premature infant named Patrick Kennedy in 1963. While the country mourned, medical scientists vowed that this would not happen again. First continuous positive airway pressure, then mechanical ventilation, changed medical care of premature newborns forever. It began an era of euphoria and excitement. Neonatologists raced to push to the edge of newborn viability. What was the youngest salvageable gestational age? What was the smallest that could be saved? Yes, we dreamed, and still do dream of artificial placentas. Ethical questions took a back seat in the search for the edge because the waters were uncharted and the tough questions could not be answered without experience. What was to be the cost in dollars and in anguish to save the Patrick Kennedys of the world? Triumphs led to grave concerns as we approached the edge. However, no advancement in neonatology has ever changed the ultimate questions. (shrink)

This paper discusses the attempt in this issue of the journal by Peter Singer, John McKie, Helga Kuhse and Jeff Richardson, to defend QALYs against the argument from double jeopardy which I first outlined in 1987. In showing how the QALY and other similar measures which combine life expectancy and quality of life and use these to justify particular allocations of health care resource, remain vulnerable to the charge of double jeopardy I am able to clarify some of the central (...) issues concerning the value of life. In particular, the idea that the value of a life varies with its life expectancy and with its quality, understood in terms of its richness, variety, success etc, is subjected to special examination. It is shown how defenders of QALYs are committed to the view that so far from all lives being of equal value, all lives are necessarily of subtly different value. The paper then analyses the use to which the notorious 'veil of ignorance' has been put both by Singer et al and by others and shows how this device of John Rawls's cannot do the work so often assigned to it. The paper then considers the issue of hypothetical consent and the role that it can play in justifying disposing of the lives of people who have not in fact consented to their lives being disposed of in particular ways. Finally, the paper makes some points about the comprehensive nature of the data collection and storage which would be required by QALY advocates and points out the independent problems attaching to licensing such comprehensive collection and use of personal data. In a recent and provocative paper, Matthew Fisher, Mariel Goddu and Frank Keil (2015) have argued, on the basis of experimental evidence, that ‘searching the internet leads people to conflate information that can be found online with knowledge “in the head”’ (2015, 675), specifically, by inclining us to conflate mere access to information for personal knowledge (2015, 674). This chapter has three central aims. First, we briefly detail Fisher et al.’s results and show how, on the basis of recent work (...) in virtue epistemology (e.g., Tiberius and Walker 1998; Roberts and Wood 2007; Tanesini 2016), their interpretation of the data supports the thesis that searching the internet is conducive to the vice of intellectual arrogance. Second, we argue that this arrogance interpretation of the data rests on an implicit commitment to cognitive internalism. Thirdly, we show how the data can be given a very different explanation in light of the hypothesis of extended cognition (e.g., Clark and Chalmers 1998; Clark 2008) – one which challenges the extent to which Fisher et al. are entitled to insist that subjects are actually conflating access to knowledge for personal knowledge in the first place. We conclude by suggesting how, against the background of extended cognition rather than cognitive internalism, we have some reason to think that searching the internet might actually foster (in certain circumstances) virtuous intellectual humility. This paper examines relationships between accountants’ personal values and their moral reasoning. In particular, we hypothesize that there is an inverse relationship between accountants’ “Conformity” values and principled moral reasoning. This investigation is important because the literature suggests that conformity with rule-based standards may be one reason for professional accountants’ relatively lower scores on measures of moral reasoning (Abdolmohammadi et al. J Bus Ethics 16 (1997) 1717). We administered the Rokeach Values Survey (RVS) (Rokeach: 1973, The Nature of Human Values (...) (The Free Press, New York)) and the Defining Issues Test (DIT) (Rest: 1979, Development in Judgment Moral Issues (University of Minnesota Press, Minneapolis, MN)) to164 graduating accounting students enrolled in capstone courses at two universities in the Northeastern United States. As potential entrants into the accounting profession, these subjects bring their values and moral reasoning to bear on attitudes and behaviors in the workplace. We find a highly significant inverse relationship between “Conformity” values and principled moral reasoning (i.e., those who prefer Conformity values have lower levels of moral reasoning). However, we also find that accounting students as a group do not prefer Conformity values above other values such as Self-actualization and Idealism, and we find positive relationships between Self-actualization and Idealism values and moral reasoning. Implications for values and ethics research are discussed. (shrink)

The Representational Theory of Measurement (RTM), especially the canonical three volume Foundations of Measurement by Krantz et al., is a landmark accomplishment in our understanding of measurement. Despite this, it has been far from easy to pinpoint what exactly we can learn about measurement from RTM, and who the target audience for RTM’s formal results should be. In what sense does RTM provide foundations of measurement, and what is the philosophical significance of such foundations? I argue that RTM provides semantic (...) foundations of measurement, and that their philosophical significance lies in a shift towards structural representation. (shrink)

It has often been suggested that people’s ordinary folk understanding of morality involves a rejection of moral relativism and a belief in objective moral truths. The results of six studies call this claim into question. Participants did offer apparently objectivist intuitions when confronted with questions about individuals from their own culture, but they offered increasingly relativist intuitions as they were confronted with questions about individuals from increasingly different cultures or ways of life. In light of these data, the authors hypothesize (...) that people do not have a fixed commitment to moral objectivism but instead tend to adopt different views depending on the degree to which they consider radically different perspectives on moral questions.
